Welcome to The Wellness Concierge, operated by Dominika Nova dba The Wellness Concierge (“we,” “us,” or “our”). These Terms and Conditions govern your use of our website, services, and any bookings or purchases made through The Wellness Concierge.
By accessing our website or engaging with our services, you agree to be bound by these Terms and Conditions.
1. SERVICES PROVIDED
The Wellness Concierge offers personalized wellness coordination services, including but not limited to:
• Wellness audits and consultations
• Appointment coordination and booking
• Ongoing concierge membership services
• Recommendations for wellness providers
We act as a facilitator and coordinator, not a direct provider of medical, therapeutic, or wellness treatments.
2. NO MEDICAL ADVICE OR GUARANTEE OF OUTCOMES
All services are provided for informational and lifestyle purposes only and do not constitute medical advice, diagnosis, or treatment. You should consult a licensed healthcare professional before making any health-related decisions. Wemake no representations, warranties, or guarantees regarding the outcomes, results, or effectiveness of any wellness services coordinated, recommended, or provided. Results will vary based on personal circumstances, your own actions and compliance, and the quality of vendor services received.
3. CLIENT RESPONSIBILITIES
By using our services, you agree to:
• Provide accurate and up-to-date information
• Attend scheduled appointments or follow cancellation policies of vendors
• Communicate any changes to your availability in a timely manner
We are not responsible for missed appointments due to inaccurate or incomplete information provided by you.
The Wellness Concierge will likewise communicate any scheduling changes, cancellations, or service disruptions to you in a timely manner.
4. VENDOR SERVICES
The Wellness Concierge may coordinate bookings with wellness vendors (e.g., spas, clinics, studios).
• We do not control or guarantee the quality, availability, or outcomes of these services
• Any services you receive are subject to the vendor’s own terms and policies
• You engage with vendors at your own discretion
5. PAYMENTS & FEES
a. Services
Fees for services are outlined at the time of purchase.
b. Payment Terms
• Payment is required in full prior to service delivery
• Memberships are billed on a recurring basis unless otherwise stated
c. Additional Fees
Additional booking requests outside of included scope may incur additional fees.
6. CANCELLATIONS & REFUNDS
a. Concierge Services
Due to the personalized nature of our services, all payments are non-refundable once services have commenced.
b. Vendor Bookings
Cancellation policies for appointments booked with vendors are subject to their individual policies.
7. MEMBERSHIP TERMS
• Memberships are ongoing and renew automatically unless cancelled prior to the next billing cycle
• You may cancel your membership with 10 business days’notice prior to your next billing cycle
• Membership services are provided on a concierge basis and are subject to reasonable and fair use
• All membership payments are non-refundable, including partial months or unused services.
8. INTELLECTUAL PROPERTY
All content on this website—including branding, text, graphics, and materials—is the property of The Wellness Concierge and may not be copied, reproduced, or distributed without prior written permission.
9. MARKETING & CONTENT USAGE
You acknowledge that The Wellness Concierge may use general experiences, written testimonials, or anonymized client interactions for marketing purposes, such as on our website or social media.
We will not share your personal or identifying information for marketing purposes without your prior written consent. This does not apply to operational sharing necessary to deliver our services, such as sharing relevant details with vendors to coordinate your appointments.
10. LIABILITY WAIVER & DISCLAIMER
By engaging with The Wellness Concierge, you acknowledge and agree to our Liability Waiver & Disclaimer, including the limitation of liability related to vendors. Please review the full policy before engaging with our services, which can be accessed HERE.
11. LIMITATION OF LIABILITY
To the maximum extent permitted by law, our total liability to you for any claim arising out of or relating to our services will not exceed the total fees paid by you for the current billing period or one-time service, as applicable. We will not be liable for any indirect, special, incidental, consequential, or punitive damages, including loss of revenue, profits, data, business opportunities, or goodwill, whether arising in contract, tort, or otherwise, even if advised of the possibility of such damages.
We are not responsible for the availability, quality, performance, or outcomes of services provided by vendors. All vendor services are subject to the vendor's own terms and policies, and you engage with vendors at your own discretion and risk.
12. MODIFICATIONS
We reserve the right to update or modify these Terms and Conditions at any time.
13. GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of British Columbia, Canada.
14. DISPUTE RESOLUTION
In the event of a dispute arising out of or relating to these Terms and Conditions, you agree to notify us in writing before initiating any legal proceedings. We will make reasonable efforts to resolve the matter within a reasonable timeframe.
15. ENTIRE AGREEMENT
These Terms and Conditions, together with any signed service agreement, our Privacy Policy, and our Liability Waiver & Disclaimer, constitute the entire agreement between you and The Wellness Concierge with respect to your use of our website and services, and supersede all prior discussions or understandings. In the event of any conflict between these Terms and Conditions and a signed service agreement, the signed service agreement shall prevail.
