Liability Waiver & Disclaimer

By engaging with The Wellness Concierge, operated by Dominika Nova dba The Wellness Concierge (“we,” “us,” or “our”), you acknowledge that we provide wellness coordination and concierge services only.
Our role is to:
• Curate recommendations
• Coordinate appointments
• Facilitate your wellness experience
We do not provide medical, therapeutic, or clinical services.
1. NO MEDICAL ADVICE OR GUARANTEE OF OUTCOMES
All services, recommendations and guidance provided by The Wellness Concierge are for informational and lifestyle purposes only and do not constitute medical advice, diagnosis, or treatment.
You acknowledge that:
• We are not licensed healthcare providers
• We do not diagnose, treat, or prescribe
• You are responsible for consulting qualified professionals regarding your health
We make no representations, warranties, or guarantees regarding the outcomes, results, or effectiveness of any wellness services coordinated, recommended, or provided. Results will vary based on personal circumstances, your own actions and compliance, and the quality of vendor services received.
2. VENDOR SERVICES
The Wellness Concierge may book or recommend services with third-party wellness vendors, including but not limited to spas, clinics, studios, and wellness practitioners.
You acknowledge and agree that:
• These vendors operate independently of The Wellness Concierge
• We do not control or guarantee each vendor’s quality, availability, practices, or outcomes
• Any services you receive are subject to the vendor’s own terms and policies
• Any services you receive are at your own discretion and risk
3. ASSUMPTION OF RISK
You understand that participation in wellness services (including but not limited to massage, skincare treatments, acupuncture, fitness, or other modalities) carries inherent risks. By proceeding with any booking coordinated by us, you confirm that you have considered the risks associated with that service and have chosen to participate voluntarily, assuming full responsibility for your choices and participation.
4. LIMITATION OF LIABILITY
To the maximum extent permitted by law, our total liability to you for any claim arising out of or relating to our services will not exceed the total fees paid by you for the current billing period or one-time service, as applicable. We will not be liable for any indirect, special, incidental, consequential, or punitive damages, including loss of revenue, profits, data, business opportunities, or goodwill, whether arising in contract, tort, or otherwise, even if advised of the possibility of such damages.
We are not responsible for the availability, quality, performance, or outcomes of services provided by vendors. All vendor services are subject to the vendor's own terms and policies, and you engage with vendors at your own discretion and risk.
5. CLIENT RESPONSIBILITY
You agree to:
• Disclose any relevant health conditions, allergies, or sensitivities directly to the vendor prior to receiving any service
• Obtain any necessary medical clearance before participating in wellness activities
• Follow all pre- and post-treatment instructions given by vendors
• Communicate any concerns or adverse reactions directly with the vendor delivering the service
• Provide accurate and complete information to The Wellness Concierge during intake and throughout the engagement
• Exercise your own independent judgment in deciding whether to participate in any recommended service
6. RELEASE OF CLAIMS
By using our services, you hereby release, waive, and discharge The Wellness Concierge from any and all claims, liabilities, demands, or causes of action arising out of or related to: your participation in any wellness service, services provided by vendors, any information provided by you, or any decisions made based on our recommendations. This release does not apply to claims arising from The Wellness Concierge's own gross negligence or wilful misconduct.
7. INDEMNIFICATION
You will defend, indemnify and hold harmless The Wellness Concierge and its contractors, agents and employees from and against any and all third-party claims, demands, actions, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or connected with: (a) any breach of these terms by you; (b) any misrepresentation made by you; (c) any information, instructions, or health details provided by you; (d) any actions taken or decisions made by you based on recommendations or information provided by The Wellness Concierge; or (e) any failure to disclose relevant health conditions, allergies, or sensitivities to a vendor prior to receiving services.
8. ACKNOWLEDGMENT & CONSENT
By engaging with The Wellness Concierge, booking a service, or purchasing an offering, you acknowledge that:
• You have read and understood this Liability Waiver & Disclaimer
• You voluntarily agree to all the terms set out in this document
Your acceptance is confirmed by checking the acknowledgment box in our booking process. Passive engagement alone (such as visiting our website) does not constitute acceptance of this waiver.
9. GOVERNING LAW
This agreement shall be governed by and construed in accordance with the laws of British Columbia, Canada.
10. SEVERABILITY
If any provision of this document is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
11. AMENDMENTS
No modification or amendment to this document will be effective unless in writing and agreed to by both parties.
12. SURVIVAL
All provisions of this document shall survive the termination or expiry of any service engagement between you and The Wellness Concierge.
13. ENTIRE AGREEMENT
This document forms part of the suite of agreements governing your engagement with The Wellness Concierge, which includes the Terms and Conditions, Privacy Policy, and any signed service agreement.
